Return and Refund Policy

All sales are final. Because Mini-Max USA products are aviation-related and we cannot verify what has happened to a product once shipped, we do not accept returns after shipment.

This Return and Refund Policy applies to purchases made from Av8r Capital Group Corp d/b/a Mini-Max USA (“Mini-Max USA,” “we,” “us,” or “our”).

Mini-Max USA sells aircraft kits, plans, parts, materials, used aircraft, partial projects, builder-assist services, and related aviation goods. Many of our products are custom made, custom cut, custom fabricated, special ordered, allocated, packaged, or prepared specifically for a particular buyer, aircraft, project, order, or transaction.

Because our products are aviation-related and because we cannot verify what has happened to a product after it has shipped, all sales are final unless Mini-Max USA expressly agrees otherwise in writing.

This policy works together with any invoice, quote, checkout terms, signed purchase agreement, addendum, or other written agreement applicable to your transaction.

1. No Returns After Shipment

Mini-Max USA does not accept returns after an item has shipped.

Once a product leaves our possession, we cannot verify how it was handled, stored, transported, exposed, modified, inspected, assembled, installed, damaged, contaminated, substituted, or otherwise affected. For safety, quality-control, liability, and traceability reasons, shipped products may not be returned for refund, credit, replacement, or exchange unless Mini-Max USA expressly agrees in writing.

This applies even if the product has not been used, installed, opened, assembled, or modified.

2. Custom Made-to-Order Products

Most Mini-Max USA products are custom made to order. Once materials are ordered, parts are cut, fabrication begins, plans or documents are issued, products are allocated, special-order items are secured, or work begins on an order, the order is non-cancellable, non-returnable, and non-refundable unless Mini-Max USA expressly agrees otherwise in writing.

This includes, but is not limited to:

  • Aircraft kits

  • Sub-kits

  • Wood kits

  • Hardware kits

  • Custom-cut materials

  • Custom-fabricated parts

  • Special-order parts

  • Allocated inventory

  • Plans

  • Drawings

  • Manuals

  • Digital or printed technical documents

  • Builder-assist services

  • Used aircraft

  • Partial aircraft projects

  • Previously started builds

  • Any item prepared specifically for a customer or project

Your master contract already supports this position by stating that deposits become non-refundable once materials are ordered, parts are cut, fabrication begins, or plans/documents are issued, and that custom-cut, custom-fabricated, special-order, or allocated materials are non-cancellable and non-returnable.

3. No Refunds for Buyer Delay, Cancellation, or Change of Mind

Refunds will not be issued because a buyer changes their mind, cancels a project, experiences financial difficulty, selects the wrong product, changes aircraft plans, no longer needs the item, finds another supplier, disagrees with lead times, refuses delivery, fails to complete payment, or fails to pick up or accept delivery.

If a buyer delays payment, refuses delivery, reverses payment, disputes payment improperly, or otherwise fails to complete the transaction, Mini-Max USA may retain deposits and prior payments to the fullest extent permitted by law. The buyer may also remain responsible for unpaid balances, shipping charges, storage charges, collection costs, and attorneys’ fees where permitted.

4. Deposits and Partial Payments

Deposits and partial payments are used to reserve production time, purchase materials, allocate inventory, begin fabrication, prepare documents, and support order-specific work.

Unless Mini-Max USA expressly states otherwise in writing, deposits and partial payments are non-refundable once any order-specific action has begun, including material ordering, cutting, fabrication, packaging, allocation, document issuance, administrative processing, or supplier ordering.

5. Plans, Manuals, Drawings, and Digital Materials

Plans, manuals, drawings, templates, technical documents, digital files, printed documents, and other proprietary materials are non-returnable and non-refundable once issued, shipped, downloaded, emailed, accessed, or otherwise made available.

Because these materials contain proprietary Mini-Max USA information and may be copied, photographed, scanned, shared, or retained, we do not accept returns or provide refunds for these items once access or delivery has occurred.

6. Used Aircraft, Partial Projects, and Used Parts

Used aircraft, partial projects, previously started builds, used parts, and secondhand materials are sold as-is, where-is, with all faults unless Mini-Max USA expressly states otherwise in a signed writing.

These items are not returnable or refundable. Buyers are responsible for inspecting, verifying, transporting, storing, repairing, completing, registering, certifying, and determining the suitability of any used or partial item before use.

7. Shipping Damage, Shortages, or Incorrect Items

Although we do not accept returns, buyers must inspect all shipments promptly upon delivery.

Any claim for obvious shipping damage, shortage, or incorrect item must be reported to Mini-Max USA in writing within five (5) calendar days of delivery. This timeframe matches the inspection and notice requirement used in the Mini-Max USA master purchase agreement.

The buyer must provide:

  • Order number

  • Buyer name

  • Delivery date

  • Photos of the packaging

  • Photos of the item

  • Description of the issue

  • Copies of carrier paperwork, if applicable

  • Any other information requested by Mini-Max USA

Failure to provide written notice within five (5) calendar days may result in denial of the claim.

8. Carrier Damage

Risk of loss passes according to the applicable invoice, purchase agreement, addendum, shipping terms, or written transaction documents. Unless Mini-Max USA expressly agrees otherwise in writing, Mini-Max USA is not responsible for carrier damage after risk of loss has passed to the buyer.

Buyers are responsible for purchasing shipping insurance unless otherwise stated in writing. If an item is damaged by a carrier, the buyer may be required to pursue a claim directly with the carrier.

9. Replacement or Correction at Mini-Max USA’s Discretion

If Mini-Max USA determines, in its sole discretion, that an item was shipped incorrectly or that a correction is appropriate, Mini-Max USA may choose the remedy. Remedies may include replacement, repair, missing-part shipment, store credit, partial credit, refund, or another solution selected by Mini-Max USA.

No remedy is guaranteed unless Mini-Max USA expressly agrees in writing.

10. Unauthorized Returns Will Not Be Accepted

Do not send any item back to Mini-Max USA without prior written authorization.

Unauthorized returns may be refused, returned to sender, disposed of, or held at the buyer’s expense. Sending an item back without authorization does not create a right to a refund, credit, exchange, repair, or replacement.

11. No Warranty Created by This Policy

Nothing in this policy creates any warranty, guarantee, promise of compatibility, promise of airworthiness, promise of certification, promise of approval, or promise of fitness for any particular purpose.

Unless expressly stated otherwise in a separately signed writing by Mini-Max USA, all goods, aircraft, kits, plans, projects, parts, materials, documents, information, and services are sold AS IS, WHERE IS, WITH ALL FAULTS.

12. Buyer Responsibility

The buyer is solely responsible for determining whether any product is suitable, compatible, complete, lawful, structurally appropriate, and fit for the buyer’s intended use.

The buyer is also solely responsible for inspection, assembly, installation, modification, repair, maintenance, storage, transportation, engine selection, propeller selection, avionics selection, weight and balance, flight testing, pilot training, registration, certification, and legal operation.

13. Policy Changes

Mini-Max USA may update or change this Return and Refund Policy at any time. The policy in effect at the time of purchase will generally apply to that purchase unless a signed written agreement states otherwise.
